These general terms and conditions (GTC) govern the use of the facilities and services of Bee Strong Fitness GmbH (hereinafter “Studio”). By concluding a membership contract, the member acknowledges these terms and conditions as binding.
Deviating or supplementary agreements must be made in writing in order to be valid.
Membership is personal and not transferable. It entitles only the member to use the agreed services.
Membership automatically expires at the end of the agreed contract period, without the need for cancellation.
Young people under 18 years of age need the written consent of a legal representative to conclude a contract. People under 14 years of age are not allowed to access the studio. Young people between 14 and 17 years of age may only train after being introduced to the studio.
By concluding the contract, the member confirms that he is in a position to take advantage of the training services offered in terms of health. Training is at your own risk.
Bee Strong Fitness does not provide medical services and does not replace medical clarification or advice. The member is expressly recommended to seek medical advice before starting training in case of health problems or pre-existing conditions.
The studio provides an automated external defibrillator (AED). In the event of a worsening of health during training, personnel must be informed immediately.
The scope of the services depends on the subscription concluded in each case. Additional offers are not included in the membership fee and must be paid separately.
Minor changes in the range of services, equipment inventory or opening hours are reserved and do not give rise to any claim for a refund or contract reduction.
Access to the studio is only possible via a personal membership card, badge or app.
A one-time fee of CHF 50.— is charged for issuing the membership card. In case of loss, the studio must be notified immediately. A replacement card costs CHF 10.—.
The means of access must not be passed on to third parties. Misuse may result in immediate termination.
The currently valid house rules form part of these terms and conditions. Staff instructions must be followed at all times.
Trial sessions may only take place during supervised hours and only after prior registration with the studio. It is not permitted to bring other people or friends to the training without the consent of the studio.
In the event of a violation of this provision, Bee Strong Fitness is entitled to issue a written warning to the member concerned. We reserve the right to take further measures in the event of repeated violations.
The membership fee is due in advance when the contract is concluded or extended.
Payment in installments is only possible by express agreement. A processing fee may be charged per installment.
In the event of late payment, a reminder fee of CHF 10.— will be charged. In addition, a default interest of 5% per year may be charged.
The use of the facilities and offers is at the member's own risk.
Bee Strong Fitness is only liable for damage that is the result of intentional or grossly negligent conduct by the studio or its assistants. Further liability is excluded to the extent permitted by law.
The member is liable for damage caused by improper use of the facilities.
It is the responsibility of the member to take out adequate insurance (in particular accident and liability insurance).
To ensure the safety of people and property, individual areas of the studio can be monitored by video.
The recordings are processed exclusively in accordance with the provisions of the Swiss Data Protection Act. The evaluation is only carried out if there is a specific reason; the recordings will be deleted in due time.
The current opening times are published on the studio's website.
Temporary discontinuation of operations or restrictions, in particular due to maintenance work, official orders or force majeure, do not give rise to a claim for a refund or extension of membership.
Membership may be interrupted upon request in the event of illness, accident, pregnancy, maternity leave, military or civilian service and vacation.
The application must be submitted before the absence on presentation of appropriate evidence. Retrospective applications are only possible in the event of illness or accident.
A time stop can be granted for an uninterrupted period of at least 14 days.
· Vacation: maximum 4 weeks per subscription year.
· Military or civilian service: maximum 21 weeks per subscription year.
· Pregnancy/ maternity leave: up to 14 weeks, based on the usual length of maternity leave in Switzerland in accordance with the income compensation regulation (EO).
The time stop only applies to annual rates.
Membership ends at the end of the agreed contract period.
In justified cases of hardship (e.g. prolonged illness), the contract may be terminated prematurely. In this case, there will be a pro rata refund of the unused time minus a processing fee of CHF 30.—.
In the event of serious or repeated violations of these terms and conditions or the house rules, Bee Strong Fitness is entitled to terminate the contract without notice and issue a house ban.
In such cases, an appropriate contractual penalty of up to CHF 500 may be charged. We reserve the right to assert further claims for damages.
There is no right to a refund in these cases.
You use the lockers at your own risk. The studio is not responsible for lost or stolen items.
The use of customer parking spaces is at your own risk. Bee Strong Fitness assumes no liability for damage to vehicles or theft.
Customer parking is only available during the stay in the studio.
Smoking and consumption of alcoholic beverages are prohibited throughout the studio.
The consumption, possession or transportation of illegal addictive substances or doping substances in accordance with the currently valid World Anti-Doping Agency (WADA) doping list is prohibited. Violations lead to termination of contract without notice.
Credit for consumption in the studio can be loaded using the access device.
There is no entitlement to cash payment. Unused credit expires upon termination of membership.
Amendments to these terms and conditions will only be made on the website www.beestrongfitness.ch/terms and conditions published.
In each case, the currently published version is decisive. It is the responsibility of the member to regularly check the current status of the terms and conditions.
Should individual provisions of these terms and conditions be invalid in whole or in part, the effectiveness of the remaining provisions remains unaffected.
Swiss law applies exclusively to the exclusion of international private law. The place of jurisdiction is the registered office of Bee Strong Fitness GmbH in Volketswil.
